PEAK Sports And Spine Centre (PEAK) collects information from you for the primary purpose of providing quality health care. We require you to provide us with your personal details and a full medical history so that we may properly assess, diagnose, treat and be proactive in your health care needs.

We are committed to providing the best possible care for you, and as part of this commitment, we are continually looking for ways to enhance our service. As part of this process, we may use artificial intelligence (AI) to assist your healthcare provider during your consultation. The AI technology helps with tasks such as generating clinical notes based on our conversations and correspondence to your healthcare team. With the use of an AI scribing tool, there is an increase in efficiency in transcribing all medical information resulting in more time spent addressing your concerns and less time on computer documentation.

PEAK is only concerned with the use of AI for the purposes of note-taking and correspondence to other healthcare professionals and is not concerned with the use of AI for diagnosing, testing or identification of any medical conditions. The AI tool does not interact with you directly. It merely listens to the conversation and creates a summary of facts. These notes are added to your patient file and only the healthcare professionals involved in your care will have access to these files.

Your privacy is of utmost importance to us. The AI system used during your consultation will adhere to strict confidentiality standards and complies with applicable data protection laws, including the Australian Privacy Principles and ISO/IEC 27001:2022.

PEAK employs strong security measures to safeguard the confidentiality and integrity of the information processed through AI transcription. Your medical data is encrypted and will remain confidential and will only be used by the AI system to assist in your current consultation.

By signing and returning this form, you agree to the use of AI technology as described above. You have the right to withdraw your consent for the use of AI at any time. It is important to note that withdrawal of consent may affect the efficiency of medical record documentation.

PEAK is committed to managing and protecting the privacy and confidentiality of your personal information. We are subject to the Privacy Act 1988 (Cth) (Privacy Act) and will adhere to the Australian Privacy Principles when collecting, using, disclosing, securing, correcting, updating and providing access to personal information. As part of its commitment to privacy, PEAK has adopted a privacy policy (PEAK Privacy Policy)

which sets out how it will deal with the management of personal information. A full copy of the PEAK Privacy Policy is available on our website and at your request.

In conjunction with the PEAK Privacy Policy, the following applies to any information that you provide to us:

  1. You authorise PEAK to collect, use, store, correct, update, disclose or otherwise process any information including personal information which relates to and/or identifies you, including but not limited to, your name, address, date of birth, employment details, contact details, emergency contact details, Medicare Australia Card information, Department of Veteran Affairs entitlement information, health insurance information, medical history and other information regarding your health and lifestyle decisions (Personal Information), to the extent reasonably necessary for PEAK to provide the services you requested from PEAK (and/or its contractors, employees, directors, officers, affiliates, subsidiaries, related parties, agents, successors and assigns) or third parties and also for the purpose of researching, developing and enhancing PEAK‘s services and/or complying with PEAK’s legal obligations;
  2. You acknowledge and agree that the types of Personal Information which PEAK collects will depend on the circumstances of its collection and the nature of your particular dealing with PEAK and you further acknowledge and agree that PEAK is required to collect certain Personal Information to ensure compliance with its legal obligations or as required by various government agencies or various regulatory bodies;
  3. You acknowledge and agree that in some circumstances, Personal Information is provided to PEAK by third parties or other organisations conducting activities on your behalf. Such third parties would include for example your medical practitioner or Medicare Australia and it is assumed that you have provided consent for your personal information to be used and disclosed to PEAK this way;
  4. You acknowledge that Personal information PEAK has collected from you (including but not limited to the information contained in this form) may be transferred to PEAK’s contractors, employees, directors, officers, affiliates, subsidiaries, related parties, agents, successors and assigns or third parties where PEAK considers it is necessary to meet the purpose for which you have submitted the Personal Information and you therefore authorise PEAK to disclose your Personal Information to any such parties to the extent necessary to perform the services to you or as otherwise required by law or with your consent;
  5. You acknowledge and agree that PEAK uses the Personal Information which you provide to PEAK to deliver services most suited to your needs. PEAK will not use your Personal Information for purposes other than those set out in the PEAK Privacy Policy without your consent or unless that use is authorised under the Privacy Act;
  6. You acknowledge and agree that the management of your Personal Information through any online practice and patient management software is not governed by PEAK’s Privacy Policy but rather, is governed by the privacy policy and terms of use of that software provider; and
  7. By completing this form and providing any Personal Information to PEAK at any time, you consent to PEAK collecting, using, storing, correcting, updating, disclosing or otherwise processing your Personal Information on the above terms and in accordance with the PEAK Privacy Policy. If you would like to access, review or modify any part of your Personal Information at any time then you should contact PEAK.

Furthermore, PEAK carries out ongoing marketing and communication activities to share stories that we think may inspire others. Images of individuals in photographs or film are treated as personal information. By signing below, you give permission for PEAK to use images, video/audio in ongoing marketing and communication.

At any time, you may withdraw your consent via written notification. If a circumstance arises that would prevent your image being used, please notify PEAK immediately.

I consent to the handling of my information by PEAK for the purposes set out above, subject to any limitations on access or disclosure that I notify PEAK of.
